Terms of Service

Welcome to out4. By accessing or using our platform at out4.events ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, purchasing tickets, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service. You must be at least 18 years old to create an account.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and account credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity under your account.

Email verification is required before purchasing tickets or creating events.

After 5 failed login attempts, your account will be temporarily locked for 30 minutes.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Ticket Purchases

When you purchase a ticket through out4:

  • You are entering into a transaction with the event organizer. out4 acts as a platform facilitating the sale.
  • All payments are processed securely by Stripe. out4 does not store your full payment card details.
  • out4 charges no platform fee. The only transaction cost is Stripe's standard processing fee (2.9% + $0.30 per transaction).
  • Tickets are non-transferable unless the event organizer explicitly permits transfers.
  • You will receive a confirmation email upon successful purchase. Standard events include a printable PDF ticket; secure-entry events use a rotating QR code shown live in the out4 app or website at the door.
  • Event organizers may set a maximum number of tickets each user can purchase per event.
4. Refunds and Cancellations

Refund policies are set by individual event organizers. Please review the refund policy listed on the event page before purchasing. In general:

  • If an event is cancelled by the organizer, you will receive a full refund to your original payment method.
  • Refund requests for other reasons must be directed through the out4 platform and are subject to the organizer's stated policy.
  • Refunds are not available within 24 hours of the event start time, regardless of the organizer's stated refund policy.
  • Refunds are processed within 5-10 business days.

5. Event Creation

If you create and publish events on out4, you agree to:

  • Provide accurate event details including date, time, location, and pricing.
  • Honor all tickets sold through the platform.
  • Set a clear refund policy for your event.
  • Comply with all applicable local, state, and federal laws regarding your event.
  • Not use the platform to promote events involving illegal activities.

Event organizers may choose to absorb the Stripe processing fee or pass it to ticket buyers. This choice must be clearly indicated on the event page.

Event organizers may create private events that require a password to access. Private events are hidden from public event listings.

Stripe Connect & Payouts

To receive payouts from ticket sales, event organizers must connect their Stripe account via Stripe Connect Express. out4 does not handle payouts directly — Stripe manages all funds transfers, tax reporting, and account compliance. By creating events and selling tickets, organizers agree to Stripe's Connected Account Agreement and applicable Stripe terms of service.

6. Prohibited Content and Conduct

You may not use the Service to:

  • Post fraudulent, misleading, or deceptive event listings.
  • Sell counterfeit or unauthorized tickets.
  • Harass, threaten, or abuse other users.
  • Upload content that is illegal, obscene, or infringes on intellectual property rights.
  • Attempt to manipulate or circumvent the platform's security or fee structure.
  • Use automated bots or scrapers without our written permission.

We reserve the right to remove content and suspend accounts that violate these rules without prior notice.

7. Intellectual Property

All content, branding, and technology on the out4 platform are owned by out4 or its licensors. You retain ownership of content you upload (event descriptions, images, etc.), but grant out4 a non-exclusive, worldwide, royalty-free license to display and distribute that content in connection with the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • out4 is provided "as is" and "as available" without warranties of any kind, express or implied.
  • out4 is not liable for the actions, content, or policies of event organizers.
  • out4 is not responsible for event cancellations, changes, or the quality of events.
  • In no event shall out4's total liability exceed the amount you paid to out4 in the 12 months preceding the claim.

These limitations do not apply to claims arising from out4's gross negligence, willful misconduct, or violations of applicable consumer protection laws.

9. Dispute Resolution

Any disputes arising from your use of the Service shall first be attempted to be resolved through informal negotiation by contacting us at support@out4.events. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

If you initiate a chargeback or payment dispute with your card issuer instead of requesting a refund through out4, out4 and the event organizer may contest the claim. Chargebacks may result in processing fees and account restrictions.

10. Third-Party Event Listings

out4 displays events from third-party sources including Ticketmaster. These events are marked with attribution and ticket purchases redirect to the original platform. out4 is not responsible for third-party event listings, ticket availability, pricing, or ticket sales conducted on external platforms.

11. Spotify Integration

out4 integrates with Spotify's Web API to enhance event discovery. When you connect your Spotify account, you grant out4 read-only access to your public profile, top artists, and saved artists for the purpose of generating personalized event recommendations. out4 does not post to your Spotify account, modify your library, or share your Spotify-derived data with third parties. You may revoke access at any time from your account settings or from Spotify's authorized apps page.

out4 also displays catalog metadata (artist names, images, genres, popularity) sourced from Spotify. All such data is attributed to Spotify with a visible logo and a link to the artist's Spotify page. By using out4, you acknowledge that Spotify's catalog data is provided under Spotify's Developer Terms and is subject to change or removal at Spotify's discretion.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

14. DMCA & Copyright

If you believe content on out4 infringes your copyright, please contact us at dmca@out4.events with:

  • A description of the copyrighted work.
  • The URL of the infringing content.
  • Your contact information.
  • A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law.

We will remove infringing content promptly upon valid notice.
